  7. The software, as defined below, is protected by copyright which is
  8. vested in Compware.
  9.  
  10. License keys, as defined below, are protected by copyright which is
  11. vested in Compware.

  13. The sofware and license keys may only be used in accordance with
  14. the terms and conditions set out in this document.
  15.  
  16. If you do not read and agree to be bound by the terms and conditions
  17. defined in this document then you are not permitted to keep or use
  18. the software or license keys in any way whatsoever and must destroy
  19. or return all copies of these items which are in your posession.
  20.  
  21. Definitions
  22. -----------

  24. The following definitions apply to the terms and conditions included in
  25. this document.
  26.  
  27. the software
  28.  means all program and information files and other documentation which are
  29.  part of the Agile HTML Editor package, with the exception of license
  30.  keys which are not part of the software.
  31.  
  32. a license key
  33.  is a code which is used to control the features available in the software,
  34.  but is not itself part of the software
  35.  
  36. an individual
  37.  means a particular person.
  38.  
  39. a use of the software
  40.  means use of the software on one or more computers by a single
  41.  individual. Where the software is used by more than one person, then
  42.  this will constitute multiple uses where the number of uses will be equal
  43.  to the number of individuals able to access the software even if
  44.  not all of the individuals with access make use of the software.
  45.  
  46. License Terms and Conditions
  47. ----------------------------

  49. The whole of this document constitutes the terms and conditions under
  50. which Compware permits the software to be stored, copied, distributed
  51. and used. Headings and punctuation serve only to assist the reader.
  52.  
  53. The laws of England shall apply to the terms and conditions set out in
  54. this document, and to all licenses granted on the basis of the terms
  55. and conditions.
  56.  
  57. Any dispute related to the terms and conditions shall either be subject
  58. to the courts of England or to the courts of the country of the individual
  59. or organisation which is in dispute with Compware, where the choice of
  60. country will be made solely by Compware.
  61.  
  62. Each individual who uses the software requires a license. Where more than
  63. one individual will use the software, or where the software is made
  64. accessible to multiple individuals, for example by installing it on a
  65. network, then this will constitute a multiple use of the software and
  66. will require one license for each use.
  67.  
  68. A license permits a single use of the software.
  69.  
  70. A free license, permitting restricted use of the software, is hereby
  71. granted to any person or organisation agreeing to abide by the terms
  72. and conditions of this document. The aforementioned free license
  73. permits use of only those features of software which are intended
  74. by Compware to be available without installation of a license key.
  75. Details of these features are available from Compware upon written
  76. request, but may be varied without notification.
  77.  
  78. An evaluation license is available for the purpose of trying the software
  79. prior to deciding whether or not to purchase a product license. An
  80. evaluation license may permit use of all or a subset of features of the
  81. software, deemed by Compware to be sufficient for evaluation. Any
  82. organisation or individual may apply for a single evaluation license,
  83. which if granted will entitle them to a single use of the software for
  84. a limited period of time. This limited period will last until the evaluation
  85. license key expires, or until 30 invokations of the software, or until 30
  86. days after first use of the software, whichever occurs first. Only one
  87. evaluation license may be applied for or used per individual or
  88. organisation. Once an evaluation license has expired an individual or
  89. organisation must cease to use the software, or must have purchased sufficient
  90. product licenses for its use(s) of the software.

  92. A product license permits a single use of the software for an indefinite
  93. period provided that the purchaser and all users of the software comply with
  94. the terms and conditions set out in this document. Non compliance with any of
  95. these terms and conditions or any other breach of the copyright vested in 
  96. Compware shall immediately invalidate the product license without compensation 
  97. or refund being due to the purchaser of the product license.

  99. The purchaser of a product license will be responsible for ensuring that
  100. all uses of the software comply with the terms and conditions described
  101. in this document.
  102.  
  103. It is the responsibility of any individual or organisation using the
  104. software to ensure that their use of the software is not in breach of the
  105. copyright of any party whose material is received or processed using the
  106. software.
  107.  
  108. Copying and Distribution
  109.  
  110. The software may be freely copied, stored and distributed by any person or
  111. organisation, providing that the person or organisation complies in full with
  112. all the terms and conditions of this document.
  113.  
  114. Modification of the software, and storage, distribution and copying of
  115. modifications to the software is prohibited.
  116.  
  117. License keys may be used in conjunction with the software only by the person
  118. or organisation which purchased the associated product license. Neither
  119. a license nor a license key may be transferred from the original end user
  120. purchaser to any third party.
  121.  
  122. License keys are not part of the software and may be stored or copied
  123. only by the person or organisation which purchased the associated license,
  124. and providing that the terms of the associated license are met in full.
  125. Such storage or copying shall be permitted solely for the purpose of
  126. using the software within the terms and conditions of this document.
  127. No person or organisation is permitted to store or copy a license key for
  128. any other purpose without written agreement from Compware.
  129.  
  130. The copyright of all license keys remains vested in Compware which reserves
  131. the right to withold or withdraw authorisation of use of all license keys 
  132. issued to a person or organisation if there is reason to suspect that the 
  133. person or organisation is involved in a breach of the terms of this document.
  134.  
  135. Warranty and Liability
  136.  
  137. Compware warrants that the media on which the software is distributed
  138. shall be free from defects and will replace defective media free of
  139. charge, on return of the defective item.
  140.  
  141. Compware has taken care in the design implementation and testing of the
  142. software, but the complex nature of computer software makes it impossible
  143. for us to warrant that it will not contain significant errors, or that it
  144. will function as intended in all circumstances.
  145.  
  146. Compware accepts no liability for any loss or damage resulting from the use
  147. of the software, regardless of whether or not any loss or damage was caused
  148. through negligent or accidental inclusion of features or errors in the
  149. software. This exclusion of liability shall extend to the distribution
  150. of damaging programs, not authored by Compware, including but not limited to
  151. computer viruses and trojan horse programs.
  152.  
  153. Variation
  154.  
  155. Any variation to the terms of this document shall only be valid if made in
  156. writing by Compware.
